Scion’s ‘SCIONSESSIONS.CA’ DRAW Contest (“Contest”)

This contest is open to canadian residents only and is GOVERNED by canadian law.

CONTEST PERIOD:

Contest begins on Monday, July 16 28, 2012 at 10:00:00 a.m. EST and ends on Friday, July 27, 2012 at 11:59:59 a.m.EST (the “Contest Period”).

 

HOW TO ENTER:

No purchase necessary.  To enter, fill out the mVIP registration form (the “Ballot”) at http://scionsessions.ca/ with: (i) your full name, email address, phone number and postal code; to be eligible to receive one (1) entry in the random grand prize draw (see below), your Ballot must be sent and received during the Contest Period.  There is a limit of one (1) Ballot per person/email address permitted per Grand Prize entry during the Contest Period and you may use only one (1) email address to enter the Contest.  If it is discovered that you attempted to enter the Contest more than once, then (in the sole discretion of the Sponsor) you may be disqualified from the Contest and all of your entries voided. The Contest Parties are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Ballots.

 

ELIGIBILITY:

Contest is open to all legal residents of Canada who are nineteen (19) years of age or older at the time of entry, except employees, representatives, agents, parent and affiliated companies, dealers, contest suppliers, promotional agencies (and those with whom such persons are domiciled) of Scion Canada, a division of Toyota Canada Inc. (the “Sponsor”).

 

THE PRIZE AND APPROXIMATE RETAIL VALUE:

There will be one (1) Grand Prize available for the contest winner and a guest of their choosing, consisting of a trip for two (2) to Toronto from anywhere in Canada including round trip airfare originating from the contest winner’s city of residence, accommodations for 4 nights stay in Toronto (August 1 – 5), Scion merchandise prize packs including promotional items and music releases, and one (1) pair of VIP passes as available or General Admission tickets valid for entry to each of the following events:

 

  • August 1 - Bassmentality w/ The Killabits at Wrongbar Toronto
  • August 2 -Nosaj Thing, Doldrums, Beta Frontiers at the Hoxton Toronto
  • August 3 - Young Widows, Coliseum & TV Freaks 7" launch at Parts and Labour Toronto
    • August 4 SLOWED w/ Ryan Hemsworth & Torro Torro at Wrongbar Toronto
 
  • August 4 - HARD featuring Justice, M83, Austra & more at Fort York Toronto

 

Selection of an individual for the Grand Prize does not affect their eligibility or chances of being drawn to win passes for any other showcase for which they have submitted a unique Ballot. Approximate retail prize value for the grand prize (the “Prize”) is $3,500. Prizes must be accepted as awarded and are not transferable or convertible to cash.  No substitutions except at Sponsor’s sole discretion and option.  Sponsor reserves the right, in its sole discretion, to substitute the Prize or a component thereof with one of equal or greater value.

 

 

PRIZE DRAW AND WINNER SELECTION:

No later than twenty-four (24) hours prior to the Grand Prize draw (the “Draw Dates”) at either of the Beyond Marketing Group Canada offices in Toronto, ON or Vancouver, BC (the “Contest End”), the winner will be selected by random draw from among all eligible entries received to date during the Contest Period for that particular prize.  The odds of winning depend on the number of eligible entries received. The Sponsor or its designated representative will make two (2) attempts to contact the selected entrant by email and/or telephone; the first of which will be no later than twenty-four (24) hours of the Contest End.  If: (i) a selected entrant cannot be contacted within two (2) attempts or within twelve (12) hours of the Contest End (whichever occurs first); or (ii) there is a return of any notification as undeliverable; then the selected entrant will be disqualified and the Sponsor reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible entries. Before being declared a winner, the selected entrant will be required to: (a) correctly answer a mathematical skill testing question without mechanical or other aid; and (b) sign and return the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Contest Rules and acceptance of the Prize as awarded; (ii) releases the Contest Parties and each of their respective officers, directors, agents, representatives, dealers, successors and assigns (collectively, the “Releasees”) from any liability in connection with this Contest, the selected entrant’s participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iii) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including without limitation, print, broadcast or the Internet. If the selected entrant: (a) fails to correctly answer the skill testing question; or (b) fails to return the properly executed Contest documents within the specified time, then he/she will forfeit the Prize and the Sponsor reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible entries.

 

GENERAL CONDITIONS:

All entries become the property of the Sponsor, which assumes no responsibility for lost, delayed, incomplete or misdirected entries.  This Contest is subject to all applicable federal, provincial and municipal laws.  The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries.

 

Residents of Quebec may submit any litigation respecting the conduct or organization of a publicity contest to the Régie des alcools, des courses, et des jeux for a ruling.  For residents of Quebec, any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

 

 

The Releasees will not be liable for any failure of any website during the Contest; for any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any entry to be received by the Contest Parties for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website; or any combination of the above.  Further, the Releasees will not be liable for any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating or downloading any material in the Contest.

In the event of a dispute regarding who submitted an entry, entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry.  “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry.  The sole determinant of the time for the purposes of a valid entry in this Contest will be the Contest server machine(s).

The Sponsor reserves the right, in its sole discretion, to withdraw or amend this Contest in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Contest Rules.  Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.  The Sponsor reserves the right, in its sole discretion, to cancel or suspend this Contest, or to amend these Contest Rules without prior notice or obligation, in the event of any accident, printing, administrative, or other error or any kind.

By entering this Contest, each entrant expressly consents to (i) the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her entry only for the purpose of administering the Contest and (2) the Sponsor and its authorized dealers for the purposes of improving products and services and better understanding your automotive needs and including you in advertising or marketing campaigns to offer you their products and/or services and for any such persons to communicate with you including by email, text or other electronic message for these purposes.  If you would prefer that we do not use your personally identifiable information for such advertising or marketing campaigns, please call Toyota Canada Inc. at 1-888-Toyota-8. We retain personally identifiable information on our databases in Toronto, Ontario for the period of time required to administer this contest and for a period of time thereafter for marketing purposes. You may review and update or correct the personally identifiable information that you provide on Ballot or change or withdraw your consent by contacting us at 1-888-Toyota-8.
